Terms & Conditions

This contract is subject to the following Terms and Conditions


1. In these conditions of Contract, The Awning and Veranda Company LTD will be referred to as “the Company” and the person or persons signing their contract to as the “Customer.”Reference to the “Product” includes all the awning and veranda we provide as well as any fixing brackets, motors and electrical wiring.


2. Nothing in these Terms and Conditions will reduce the Customer’s statutory rights in relations to faulty, mis-sold for purpose or service provided.


3. Payment. A deposit is to be paid on the signing of the Contract, with the remaining outstanding balance paid upon completion to the customers complete satisfaction on the day of installation.

 

4. The Contract is subject to a SEVEN day cooling off period from the date the Contract is signed. Charges may be applied to cover costs incurred if cancellation occurs outside of the SEVEN days cooling off period.

 

5. Should you wish to cancel your order with the Company, it must be done in writing and delivered within SEVEN days of the signing of the Contract.

 

6. The Company intends to rely upon the written terms set out in these Conditions of Contract. If the Customer requires any changes to the Terms and Conditions, they should be put in writing and delivered to the Company before the Contract is signed. This way both the Customer and Company can avoid any problems before continuing with any orders.


7. All Products are made to order from the choices of the Customer.


8. The address on the Contract is the installation address for the Product.


9. The Company shall retain ownership of the Product fitted until the Customer has paid the final balance.


10. The installation dates and times are given in good faith but are only approximate. Any changes out of the Company’s control, which causes a delay, can not be blamed on the Company. The Company shall not be liable for any losses or damages suffered by the Customer due to a delay.

 

11. The Company does not accept any liability for any minor imperfections within the fabric of an awning arising in the handling or manufacturing process. There is typically a rippling effect from the seams of the fabric that can cause some creasing. This is a common characteristic of this type of heavy-duty fabric, and these minor imperfections are not considered a fault.

 

12. The Company will always aim to survey the location of the installation for the product. This is for the following reasons
A. The product is fit for purpose to meet the Customer's needs and expectations.
B. The product can be fitted where the Customer wants it due to structural reasons.
C. The Customer agrees the position of the product before any work occurs as any
costs/repairs needed if the Customer make changes after the Product has been
installed, is paid by the Customer.
D. It is recommended that all decision makers are present upon the site survey, so all
options are discussed and finalised before the Contract is signed.
E. All width and projection’s will be discussed on survey. It is wholly the Customer’s
responsibility to ensure that their chosen Product is of sufficient width and projection
to provide the coverage that is required to suit their needs.
F. It is the Customer's sole responsibility that the frame and/or fabric colours are correct
at survey before the Contract is signed.

 

13. In the event the Company is unable to install the Product for reasons beyond the Company's control, the Customer and the Company will each be entitled to rescind the Contract and the Company will return the entirety of the deposit to the Customer.

 

14. It is the Customer's responsibility to inform the Company of any planning consent, building regulations or landlord consent. Any application processes are to be undertaken fully by the Customer, with the Company providing the appropriate information needed to support any application.

 

15. The Company will guarantee the Product for a period of 5 years from the date of installation. The guaranteed conditions are as follows
A. Any alteration to the Product not completed by the Company or given permission in
writing from the Company will nullify and void the guarantee.
B. Any damage to the Product through misuse will nullify and void the guarantee. Examples of this but not limited to are, using an awning in heavy rain, open flame cooking or heating under an awning or polycarbonate/glass roof.
C. Reasonable wear and tear are expected. Any maintenance of the Product will be
explained at the completion of the installation.
D. The guarantee excludes heater elements, fuses, bulbs, and batteries.
E. The guarantee excludes damage caused by severe or extreme weather conditions and
other such natural events.

16. All extra framework is made from mild steel that is primed and powder coated.

 

17. Any hardwood packers required will be covered with uPVC or painted to help prevent weathering.

 

18. It is the Customer’s responsibility to provide a 13amp three pin socket or dedicated switch spur if there is not one located at survey.

 

19. It is the Customer’s responsibility to redirect boiler flues to comply with regulations. Any arising issue will be highlighted on the survey.

 

20. Awnings are designed to prevent sunlight but can be used in light rain if the pitch of the awning is over 16 degrees. A “light rain” is classed by the Company as when no water is settling on the fabric creating a pool of water. It is the Customers responsibility to not leave any awnings, not designed as an all-weather system, out in the rain or snow.

 

21. Any fabric that is retracted wet, must be opened and aired at the next convenient opportunity. Retracted wet fabric that are left can cause damage over an extended period.

 

22. With our verandas, a concrete base is required for underneath the posts to support the weight of the unit. This often means existing slabs need to be lifted. Every care is taken when lifting to not damage the slab and those surrounding it. It is the Customer’s responsibility to provide spare slabs before the installation in case of breakages. The Company will relay any lifted slabs.

 

23. The Company shall not be liable for losses that were actually unforeseeable to the parties when the Contract was formed, for losses not caused by the Company's breach of Contract or for any business losses.

 

24. The Company will try to resolve any disagreements quickly and efficiently. However, these Terms and Conditions are governed by English law, and both the Customer and Company agree to submit to the non-exclusive jurisdiction of the English courts.
